Content

Transmission, storage, or presentation of any information, data or material in violation of any law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. Also prohibited are sites that promote any illegal activity or present content that may be damaging our servers or any other server on the internet. Links to such materials are also prohibited. Examples of unacceptable content or links: Pirated software hacker programs or archives, warez sites, or pornagraphic websites.

Traffic Usage

All account plans come with a predetermined amount of traffic allowance. We monitor all accounts and bill $5.00USD for each gig of traffic exceeded at our discretion. Spamming, or sending of unsolicited e-mail, from any of our servers or using an e-mail address or domain that is maintained on our server machine as reference is strictly prohibited. Perfect Hosting Inc. has the right to determine what is acceptable and what is not.

Background Programs

We do not install or allow any programs required to run through root access on the servers. Most scripts can be run through the users own account and does not require root access. If at any time you are trying to install programs that require root access to any machine then your account will be locked and we will contact you.

Backups

Backups of the site is the SOLE RESPONSIBILITY of the user. You can use the “backup” feature built into the Plesk Control Panel. However, Perfect Hosting Inc. does do periodic backups of all systems incase of failure.

Refusal of Service

We reserve the right to refuse, cancel, or suspend service at our sole discretion.

Billing

All prices are in U.S. Dollars and are due before the account is activated.

Recurring Billing: You will be notified by email to the address you specified when you signed up when your billing cycle is coming up. You will be required to follow the instruction in the email and pay on or before the day your bill is due. Failure to do so may result in account deactivation or deletion.
Non Payment : It is the client's responsibility to ensure that they have recieved the invoice and pay it before it is due. Many times we will give a grace period if it is a rare occurance for the account, but abuse of this grace period will result in account deactivation or deletion. Perfect Hosting Inc. has the right to deactivate/delete any account that is overdue.
Account Deactivation: Any account deactivated due to non-payment must contact the billing department to reactivate it. We cannot guarantee that your account will be activated or that the data will be fully intact for overdue accounts.
Refunds: There are very few times that Perfect Hosting Inc. will offer refunds. The only time where you will get a refund is if the Perfect Hosting Inc. servers are down for an extended period of time (approx 2 days but at our discretion.)

Cancellations

If you really want to cancel your service with us, the proper way to do it is to submit a support ticket through your account (http://billing.perfecthostinginc.com). Please include the reason you are cancelling and when you want it cancelled.

Limitation of Liability

Perfect Hosting Inc. shall not be responsible for any claimed damages, including incidental or consequential damages, which may arise from Perfect Hosting Inc. servers going off-line or being unavailable for any reason whatsoever. Furthermore, Perfect Hosting Inc. shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from any corruption or deletion of any web site from one of our servers. All damages shall be limited to the immediate termination of service.
Violations of these Terms of Service should be referred to Perfect Hostinc Inc. All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation.

Perfect Hosting Inc. retains the right to change any or all of the above Policies, Guidelines, and Disclaimers without notification so please check back often to ensure you are up-to-date.
